PRIVACY AND COOKIE POLICY OF BELKABOO PROPRIETARY LIMITED

Introduction

Belkaboo Proprietary Limited ("Belkaboo") is a private company duly incorporated in accordance with the laws of South Africa.

Belkaboo is committed to maintaining the privacy and security of customers' personal information, which includes information that identifies or relates specifically to a person such as their names, email address and physical address, mobile phone numbers, date of birth and gender ("customer information").

Belkaboo also receives vendors' personal information and is committed to maintaining the privacy and security of its vendors ("vendor information").

The security of such customer information and vendor information submitted via the Belkaboo electronic platform (known herein as "the platform")

is dealt with as set out in this policy ("policy"), read together with the Terms of Use.

This policy sets out the following:

  • What customer information and vendor information Belkaboo collects and holds
  • Why Belkaboo collects that information
  • To whom Belkaboo discloses customer information and/or vendor information to

By using the Belkaboo platform, the customer and/or vendor agrees to the terms and conditions stated in this policy.

What Customer information and vendor information Belkaboo collects and holds

Customer Information:

Customers may access certain areas of the platform without registering any details. However certain areas of the platform may require the customer to register on the platform.

If a customer submits an application to access these areas, the customer is indicating that it has read this policy and is willing for Belkaboo to deal with such customer's customer information as set out in this policy.

Belkaboo is not directly involved in the transactions between customers and vendors and does not hold any customer information other than as specified in this policy.

The type of information Belkaboo collects and holds will depend on the purpose for which it is collected and used. We will only collect information that we need for that purpose:

  • Belkaboo collects information directly from the customer where the customer provides Belkaboo with their personal details, for example when the customer submits enquiries directly to Belkaboo or submits a profile registration on the platform. Where possible, Belkaboo will inform the customer what information is required and what information is optional.
  • Belkaboo also collects information about the customer from other sources such as information collected using “cookies” which allows Belkaboo to collect standard internet visitor usage information (see more information below regarding "cookies").

    • Belkaboo requires the following customer information from a customer as part of the customer registration process to enable a customer to have access to certain areas of the platform (i.e. to purchase items listed on the platform):

  • name;
  • physical address;
  • email address;
  • password;
  • mobile phone number;
  • gender; and
  • date of birth.

    • Belkaboo requires the following vendor information as part of the vendor registration process to enable a vendor to sell list and items on the platform:

  • if the vendor is a natural person-
  • a vendor's name;
  • email address and physical address and
  • contact numbers.
  • if the vendor is an entity-
  • the entity's name;
  • registration number; and
  • country of incorporation;

    • Belkaboo has also entered into contracts with third party operators who process customer information and/or vendor information on behalf of Belkaboo. In circumstances where a third party operator may provide services to Belkaboo whereby such operators would need to access customer information and/or vendor information, such operators enter into an agreement to uphold Bekaboo's privacy undertakings as set in this policy.

    Why Belkaboo collects that information

    Belkaboo collects such information about the customer and/or vendor only for the purpose for which it was collected, including:

  • to personalize user experience (customer/vendor information helps Belkaboo to better respond to user’s individual needs)
  • to fulfil a customer's purchase of any goods listed on the platform;
  • to enable a vendor to list items and sell items on the platform and to enable Belkaboo to invoice the vendor for fees payable to Belkaboo;
  • to improve customer service (user information helps Belkaboo to more effectively respond to customer and vendor service requests and support needs);
  • to improve the Belkaboo platform (Belkaboo continuously strives to improve its platform offerings based on the information and feedback received from customers and vendors);
  • to administer a contest, promotion, survey or other site feature;
  • for a customer to receive marketing communications from Belkaboo and/or any of its vendors on the platform provided the customer consents to receiving such marketing information as part of its on-line registration; and/or
  • to comply with applicable laws.

    • To whom Belkaboo discloses customer information and vendor information to

    Belkaboo discloses customer information to its vendors. Belkaboo only discloses certain customer information to the vendor to enable the vendor to deliver an item to the customer which the customer has purchased on the platform.

    In addition, Belkaboo will only disclose customers' customer information if:

  • required by applicable law;
  • Belkaboo has a public duty to disclose the information;
  • Belkaboo's legitimate interests require disclosure or the customer's legitimate interests require disclosure; or
  • the customer agreed that Belkaboo may disclose his/her/its customer information, including but not limited to marketing communications.

    • Belkaboo will only disclose vendor information if:

  • required by applicable law;
  • Belkaboo has a public duty to disclose the information;
  • Belkaboo's legitimate interests require disclosure or the customer's or vendor's legitimate interests require disclosure; or
  • the vendor agreed that Belkaboo may disclose his/her/its vendor information.

    • How long does Belkaboo hold customer information and/or vendor INFORMATION for

    Belkaboo generally retains the customer information and/or vendor information while the customer's account and/or vendor's account is in existence, or for as long as is necessary if legally required even after closure of a customer account and/or vendor's account.

    How Belkaboo safeguards that information

    Belkaboo is dedicated to safeguarding information and as such takes reasonable precautions to protect customer information and vendor information and prevent the misuse of such information, as supplied to Belkaboo. Belkaboo implements a variety of security measures to maintain the safety of customer and vendor information. Belkaboo offers the use of a secure server. All supplied sensitive information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our payment gateway providers database, only to be accessible by those authorized with special access rights to such systems. Such authorized personnel are required to keep the information confidential.

    The customer and vendor are responsible at all times for keeping their password and username safe.

    If the customer uses a hyperlink to a third party website, please note that these websites have their own privacy policies and use of cookies. We do not accept responsibility for customer information provided to a third party website.

    Transfer of information inside and outside South Africa

    The customer information and/or vendor information that Belkaboo collects may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who works for Belkaboo or one of our operators. By making an application on this platform and providing the platform with customer information and/or vendor information, the customer or vendor, as the case may be, hereby consents to the transfer of their customer information or vendor information both inside and outside the European Union and/or South Africa.

    Unfortunately, the transmission of information via the Internet is not completely secure. Belkaboo will do its best to protect customer information and vendor information, but cannot guarantee the security of data transmitted to the platform; any transmission is at your own risk.

    Customers' and Vendors' rights to access and correction OF SUCH information

    As the information which is uploaded onto the Belkaboo platform may be customer information and/or vendor information, the customer or vendor has a right to request access to their information that Belkaboo holds in respect of such customer or vendor.

    Should any customer or vendor request access to customer information or vendor information Belkaboo holds in respect of such customer or vendor respectively, or if the customer or vendor wants to update or correct any of its information held by Belkaboo, the customer or vendor (as the case may be) can contact Belkaboo or the customer or vendor can update and correct their information themselves by logging onto their account.

    Since Belkaboo is not responsible for any representations or information or warranties or content on any listings supplied by the vendor to Belkaboo, as set out in the Terms of Use, Belkaboo does not exercise control over the vendor's privacy policies and each customer should refer to the privacy policy of any such vendor to see how such vendor protects a customer's privacy.

    Belkaboo's Cookies policy

    Belkaboo uses "cookies" when a user visits the platform.

    A "cookie" is a small text file that is downloaded onto an electronic device, when a user of the electronic device accesses a website, such as this platform. It allows the website to recognize that user’s device and store some information about the user’s preferences or past actions.

  • Transient cookies or site functionality cookies: Such cookies only exist for the duration of customer's platform visit and are deleted on exit. They recognize customer's as a customer moves between pages, for example these cookies allow customers to navigate the platform and use Belkaboo's features, such as “Add to basket”
  • Persistent cookies: These cookies stay on a customer's device until they expire or are deleted. These cookies often store and re-enter customer's login information, so customers don't need to remember membership details
  • Site analytics cookies: These cookies allow Belkaboo to measure and analyze how Belkaboo’s customers use the platform, to improve both its functionality and customers shopping experience.
  • Targeting or advertising cookies: Such cookies are used to deliver advertisements relevant to customers and/or vendors. They also limit the number of times that customers and/or vendors see an advertisement and helps Belkaboo measure the effectiveness of Belkaboo’s marketing campaigns.

    • Belkaboo uses cookies to:

  • store details of customer marketing, product preferences to improve Belkaboo's targeting and enhance customers journey through the platform; and
  • evaluate Belkaboo's platform in respect of advertising and promotional effectiveness.

    • To enable or disable cookies, follow the instructions provided by your browser (usually located within the 'Help', 'Tools' or 'Edit' facility) or contact Belkaboo.

    Changes to this Policy

    Belkaboo reserves the right, in its sole discretion, to amend this policy at any time by posting the amended policy on our platform. Unless otherwise stated, the current version will apply each time a user accesses our platform.

    Users agree to review this policy whenever users visit this platform for any such amendments.

    Save as expressly provided to the contrary in this policy, the amended version of this policy shall supersede and replace all previous versions thereof.
